Ordinance 2003-040 Adobe Acrobat File dated December 9, 2003 repeals Section 103.03.3, "Building Code Board of Adjustment and Appeals". This section has been replaced by Section 110 of the Florida Building Code and the duties of responsibilities of the former Building Code Board of Adjustment and Appeals will be assumed by "The Construction Board of Adjustment & Appeals" which has already met and elected officers.

Ordinance 2001-020 Adobe Acrobat File dated July 17, 2001 reorganized the makeup of this Board per 2001 Florida Building Code (Section 110.2.1).

The Construction Board of Adjustment and Appeals should consist of nine (9) members, but not less than seven (7). The Board shall be appointed by the Applicable Governing Body. The Construction Board of Adjustment and Appeals should be composed of:

Two (2) Division I Contractors
One (1) Electrical Contractor
One (1) Mechanical Contractor
One (1) Plumbing Contractor
One (1) Architect
One (1) Engineer
Two (2) Members of the General Public, whenever possible.

Members appointed by the Board of County Commissioners.

A board member shall not act in a case in which he has a personal or financial interest.

Term of office of the board members shall be staggered so no more than 1/3 of the board is appointed or replaced in any 12 month period. Vacancies shall be filled for an unexpired term in the manner in which original appointments are required to be made. Continued absence of any member from required meetings of the board shall, at the discretion of the applicable governing body, render any such member subject to immediate removal from office per 2001 Florida Building Code (Section 110.2.2). Members serve a 4-year term.

Note: Per Chapter 2000-243, Laws of Florida, new board members are required to complete a full financial disclosure (Form 6) or a limited financial disclosure (Form 1), and upon leaving, must file a final disclosure statement within 60 days. Failure to do so will be subject to automatic fines of $25 for each late day, up to a cap of $1,500.
