I.   ROLL CALL AND PLEDGE OF ALLEGIANCE
 
The Indian River County Code Enforcement Board was established by the Board of County Commissioners pursuant to 
Florida Statutes Chapter 162 to provide a fair and speedy method for enforcing the county's codes and regulations.
 
Initially, when a violation of a county code or regulation comes to the attention of a County Code Enforcement Officer, the 
officer notifies the persons responsible for the violation and, if it is a violation that requires correction, the officer gives the 
responsible person a reasonable period of time to take corrective action and bring the property into compliance with the 
codes and regulations.
 
If, after expiration of the time for correction given by the County Code Enforcement Officer, the violation has not been 
corrected by the persons responsible, the officer will then request that the Code Enforcement Board schedule a hearing 
concerning the violation. A notice of hearing is sent to the persons responsible for the violation which advises those persons 
of the date of the hearing before the Code Enforcement Board.
 
The hearings before the Code Enforcement Board are "quasi-judicial" which means that the Code Enforcement Board acts 
like a court of law. The Code Enforcement Board acts like an independent panel of judges to hear testimony and review the 
evidence presented in each case and then makes a decision as to whether or not the violation exists, how much time to grant 
the persons responsible to correct the violation if correction of the violation is required, and the amount of costs and fines 
that are to be assessed pursuant to Florida Statutes  §  162 . 09.
 
If the Code Enforcement Board has previously found that a violation existed in your case and the Code Enforcement Board 
gave you additional time in which to correct the violation, the Code Enforcement Board may also determine whether or not 
the violation was corrected and, if not, whether you should be given additional time to correct the violation and/or whether 
costs and fines should be imposed against you. The Code Enforcement Board may also determine whether or not a repeat 
violation exists.
 
While hearings before this Code Enforcement Board are similar to court hearings, formal rules of evidence do not apply, but 
fundamental due process will be observed and will govern the hearings. All testimony in each case must be under oath or 
affirmation. In a few minutes, everyone intending to testify or speak to the Code Enforcement Board must be sworn in by the 
Secretary of the Code Enforcement Board.
 
When your case is called, the County Code Enforcement Officer will first present the County's case against you and will 
explain to the Code Enforcement Board the reasons why he or she believes that you have violated the County's codes or 
regulations. Once the Code Enforcement Officer is finished speaking, you will then have the opportunity to ask questions to 
the Code Enforcement Officer or any other person testifying against you concerning your alleged violation. Please alert the 
Chairman of the Code Enforcement Board right away if you have any questions for the Code Enforcement Officer or other 
person testifying against you.
 
The Code Enforcement Officer or other county official may present photographs, documents or other physical evidence of 
your alleged violation to the Code Enforcement Board for its review. You will first be shown that evidence. If you have any 
objection to the evidence, please alert the Chairman of the Code Enforcement Board right away, otherwise your objections 
will be waived and the Code Enforcement Board will then review and consider that evidence.
 
After the Code Enforcement Officer or other county official has finished presenting the County's evidence, you will then 
have the opportunity to testify and present your evidence and any witnesses you may have in your defense. The Code 
Enforcement Officer or other county official or the Code Enforcement Board may ask you or your witnesses further 
questions about the alleged violation. Any of your own evidence that the Code Enforcement Officer or other county official 
does not object to or which the Code Enforcement Board allows to be considered will be retained by the Secretary to the 
Code Enforcement Board.
 
After all the testimony and evidence has been presented to the Code Enforcement Board, the Code Enforcement Officer or 
other county official usually makes a recommendation to the Code Enforcement Board concerning the decision it should 
make in your case. You may ask the Code Enforcement Board to make a different decision or you may discuss a change to 
the recommendation with the Code Enforcement Officer or other county official.
 
If the Code Enforcement Board determines that a violation of the County's codes or regulations has occurred, the Code 
Enforcement Board will also specify the amount of time that you will have to correct or remedy the violation and will set 
the amount of the fine that will be imposed if the violation is not corrected by that date or deadline.
 
For example, if today the Code Enforcement Board gives you until the next hearing date to correct the violation and the 
next hearing date is Monday, July 27, then you must have the corrections completed on or before Friday, July 24. The 
hearing to be held on Monday, July 27 will be held to determine whether or not you have corrected the violation. You 
should plan on attending the hearing scheduled for Monday, July 27. However, if you have corrected the violation before 
that date and have also notified the Code Enforcement Officer you will usually not be required to attend the next hearing. It 
is very important that you contact the Code Enforcement Officer and request a re­inspection once you believe that you have 
corrected the violation.
 
The Code Enforcement Board may also impose fines upon you, not exceeding the limits set forth in Florida Statutes 
Chapter 162. The amount of the fine will be determined using the factors set forth in Chapter 162. If fines are imposed, the 
order will be recorded in the Indian River County public records and will become a lien against your real and personal 
property. If the lien established by the order is not paid, it may be foreclosed upon and your property sold to satisfy the lien. 
The Code Enforcement Board may also order that all costs incurred by the county in enforcing its codes and regulations, 
including any reasonable costs of repair incurred by the county, be paid by you.
 
Before we begin with the hearings, please turn off your cell phones or put them on vibrate. When your case is called, please 
come forward and take the podium to my left. When you arrive at the podium, please state your name and confirm to the 
Code Enforcement Board that you have taken the oath or have affirmed that you will tell the truth. Please place your name 
on the sign in sheet located on the top of the podium so the Clerk will have a record of your attendance.
